01Agreement to these terms
These Terms of Service (“Terms”) apply to your use of www.nashecommerce.com and to the services provided by Nash ECommerce LLC (“Nash”, “we”, “us”). By using our website or services, you agree to these Terms. If you do not agree, please do not use them.
02Our services
We provide digital marketing services, including branding and design, social media and advertising, SEO, AEO and GEO, websites and landing pages, reviews and reputation management, and marketing analytics. The exact scope, deliverables and fees for each client are set out in a written proposal or quote that you approve before work begins.
03Free marketing audit
Our free audit is offered with no cost and no obligation. It is a general assessment based on publicly available information and the details you provide, intended for information only. It is not a guarantee of results.
04Your responsibilities
- Provide accurate, complete information and timely access to the accounts we need (for example Google Business Profile, website and social media).
- Review and approve plans and content within a reasonable time.
- Make sure any materials you give us (logos, photos, text) are yours to use.
- Keep your account logins secure.
05Fees, billing and cancellation
- Fees are as stated in your approved proposal or quote.
- Services are month-to-month, with no long-term contract. You may cancel with 30 days’ written notice.
- Fees for work already performed and any third-party costs (such as ad spend or software) are not refundable.
- Advertising budgets are paid to the platforms (for example Google or Meta) and are separate from our fees.
06No guaranteed results
Search engines, AI assistants and social platforms control their own rankings, answers and algorithms. We use proven practices and work hard to grow your visibility and leads, but we cannot guarantee specific rankings, AI mentions or citations, traffic, leads or revenue.
07AI-assisted work
We use AI tools to help research, draft and analyse. Every strategy and piece of content is reviewed by a person before it is used or published, and you approve key deliverables. You remain responsible for confirming that published claims about your business are accurate.
08Ownership and intellectual property
- You own your accounts, your website, your data and the final deliverables we create for you once the related fees are paid.
- We keep ownership of our own tools, templates, methods and know-how, and may use general learnings (never your confidential information) in our work.
- The content of this website belongs to Nash ECommerce LLC and may not be copied without permission.
09Third-party platforms
Our services rely on third-party platforms such as Google, Meta, Microsoft and AI providers. Their terms and policies also apply, and they may change features, rules or availability at any time. We are not responsible for their decisions, outages or policy changes.
10Confidentiality
We keep your non-public business information confidential and use it only to deliver our services. We handle personal information as described in our Privacy Policy.
11Using this website
Use our website lawfully. Do not attempt to disrupt it, gain unauthorised access, submit false information or spam through our forms, or copy its content for commercial use. Website content is general information, not professional, legal or financial advice.
12Disclaimers and limitation of liability
Our website and services are provided “as is”. To the fullest extent permitted by law, Nash is not liable for indirect, incidental or consequential losses, such as lost profits or data. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.
13Indemnity
You agree to indemnify Nash against claims arising from materials you provide, your products or services, or your breach of these Terms.
14Ending services
Either party may end services with 30 days’ written notice. We may suspend or end services sooner if fees remain unpaid or these Terms are seriously breached. On ending, we will hand back access to your accounts and the deliverables you have paid for.
15Governing law and changes
These Terms are governed by the laws of the State of Texas. We may update these Terms from time to time, and the current version will always be posted on this page. Continued use of our website or services means you accept the updated Terms.
